Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the PersoScan software, services, and related documentation (collectively, "Service") provided by the individual operator based in Lithuania. By purchasing, accessing, or using the Service, you agree to be bound by these Terms.

2. Services Provided

PersoScan offers an embeddable anatomical body map widget and a Shopify storefront app that help businesses turn body area interactions into navigation toward relevant products, collections, pages, services, or specialist routing. The Service is a commercial software product and not a medical device.

The Shopify integration is intended for storefront navigation behavior and does not expose the form or pain-submission workflow.

3. Eligibility

You represent that:

• You are at least 18 years old.
• You have legal capacity to enter into a contract.
• You are using the Service for lawful commercial purposes.

4. License and Use Rights

4.1 Direct Widget Access

• PersoScan is licensed, not sold.
• Direct website/widget subscriptions may use license keys, domain registration, and plan limits that differ by subscription tier.

4.2 Shopify App Access

• Shopify app access is granted through app installation in a merchant's Shopify store and is subject to the active plan, store configuration, and Shopify platform rules.
• Shopify storefront functionality may depend on theme app extension placement, app proxy availability, and the merchant's active Shopify subscription status.

4.3 Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the widget's software.
• Attempt to extract underlying assets (models, code, images).
• Scrape, abuse, or misuse the Service.
• Resell or sub-license any component of the Service beyond permitted domain usage.

5. Subscription and Payments

• The Service is offered on a subscription basis (monthly, yearly).
• All prices are inclusive of applicable VAT.
• Direct website purchases may be processed through Stripe or another payment processor shown at checkout.
• Shopify app subscriptions are billed and managed through Shopify's billing system where applicable.
• Subscriptions may auto-renew unless cancelled before the next billing cycle.

6. Activation and Plan Changes

• Direct widget access may require a valid license, domain registration, or another activation method communicated during purchase or onboarding.
• Shopify app access is activated through Shopify app installation, theme app extension setup, and any plan selection made inside Shopify admin.
• Plan changes, renewals, and cancellations for Shopify app subscriptions are handled through Shopify where applicable.

7. Support and Setup

• PersoScan may provide documentation and best-effort support for setup and operation.
• There is no guaranteed response time; support is provided on a best-effort basis.

8. Refund Policy

Refund requests may be reviewed in accordance with the payment channel used for purchase. If a refund is approved, the related subscription or access rights may be reduced or terminated. Shopify purchases and refunds must be handled consistently with the original payment processor and platform billing flow.

9. No Warranty

The Service is provided as-is, without warranty of any kind. This includes implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PersoScan and its operator are not liable for:

• Any indirect, incidental, special, punitive, or consequential damages.
• Loss of profits, data, or business interruption.

Where liability cannot be excluded, it is capped at the total amount paid by you for the Service in the 12 months preceding the claim.

11. Termination

PersoScan may suspend or terminate your access if you materially breach these Terms, including misuse or unauthorized extraction of assets.

12. Governing Law and Dispute Resolution

• These Terms are governed by the laws of Lithuania.
• Disputes shall be resolved in the courts of Lithuania.
